YouTube has won an important case in the Spanish courts, when broadcaster Telecinco sued the video sharing giant for copyright infringement. But the court ruled that YouTube is not liable for content uploaded by its users.
This follows a similar ruling in which Viacom's case was knocked back by a court in the US for failing to prove infringement has occurred. European laws have similar provisions to the US DMCA in which content hosts and service providers receive protection as long as they have adequate anti-infringement policies. This is dubbed the safe habor provisions.
Telecinco has vowed to appeal the decision.
