    Obama's Supreme Court Nominee - Friend or Foe To MPAA/RIAA?

    President Obama recently nominated Elena Kagan, Solicitor General of the United States, to replace Justice John Paul Stevens of the US Supreme Court when Justice Stevens retires soon. But this nomination may have lasting effects on the future of the copyright crusade by the movie and music industry, represented by the MPAA and RIAA.

    While the Obama administration has been very friendly towards the MPAA and RIAA, and Vice President Biden has always been a supporter of the RIAA, when it comes to Elena Kagan, the picture is not so clear.

    When Kagan was the Dean of Harvard Law, she was responsible for recruiting Lawrence Lessig and others who held strong views towards fair use and how it needs to be protected. She herself has argued against the entertainment industry in relations to a copyright dispute, when Cablevision has proposed a cloud based personal video recorder system, which the entertainment industry firmly opposed.

    So it appears the US may get the first Supreme Court Justice that understands the fairly complex issues involved with fair use, and has at least the in past been willing to fight for it. Whether this translates to any actual rulings, we'll have to wait and see.
