Nintendo has filed a lawsuit against New York based NXPGAME for selling R4 flash carts online. R4 flash carts extend the functionality of Nintendo DS consoles by offering multimedia playback and other functions, but it is more commonly used to play illegally downloads games, or ROMs.
Nintendo alleges that NXPGAME originally agreed to cease selling these kind of flash carts, but instead, created and opened an identical website and redirected former customers to the new website to continue selling the carts.
In 2009, an US court had already ruled that R4 carts violate the Digital Millennium Copyright Act and is considered to be illegal.
