The AFACT lost the lawsuit and the judge ordered them to pay cost, including that of iiNet, but the AFACT is going to take iiNet back to court this week to see if they can recoup some of it back.
Arguing that iiNet delayed proceedings in court by not acknowledging the existence of copyright infringement on their network sooner, and the AFACT also wants recoup costs in sections of the case that the judge upheld in their favour.
iiNet's CEO, Michael Malone says it's a case of you lose, you pay. "We didn't ask to be sued. They came to us and sued us and they lost, so I don't see why we should be paying any of their legal expenses," Malone said to ZDNet.
