I think the practical point about prosecution is that governments don't like to prosecute voters and of course will not do so. They go after major league pirates or companies that assist in piracy. So much for the DMCA.
Similarly, it's a waste of time and money for the MPAA/RIAA etc to go after an individual just backing up (or even pirating) the odd DVD or so. They also go where it hurts the most - at producers of products that assist the mass market in piracy (e.g 123 Studios and even poor Lightning UK!). In other words, they look to close things down at the "wholesale level", thereby hurting lots of people.
IMHO, we at DVF do not have the luxury to be as lenient as a government would be to an individual, as we are not a government seeking their vote. We are a loose collection of folks, united by a common interest, subject to the very same prosecution by various governments and associated interests world-wide. In truth, should DVF be a seen as a major aider and abetter of piracy, the various governments/MPAA etc would have no hesitation in closing us.
And how easy would it be for admin to defend himself? Not at all! It would simply cost too much (as LUK! found out). And don't go hoping the EFF will triumph our needs - they are a real joke.
That is why I believe it is important to be vigilant to protect the fantastic forum we have so no-one can accuse us of assisting pirates. Only in this way, can we be assured we can stick around.
