Viacom is set to appeal the decision earlier in the year that saw their case against video sharing website YouTube thrown out of court. Google, the owners of YouTube, had asked for a summary judgement which the judge granted.
The appeal was filed on Wednesday with the US Second Court of Appeals in New York. "We are disappointed with the judge's ruling, but confident that we will win on appeal," Viacom posted on their website in relation to the appeal. "It is, and should be, illegal for companies to build their businesses with creative material they have stolen from others."
